Welcome to Shante Clothing, a clothing brand dedicated exclusively to tall women. By accessing or using our website (the "Site"), you agree to comply with and be bound by these Terms of Service, as well as our Privacy Policy and any additional terms, guidelines, or policies referenced herein. Please read these terms carefully before making a purchase or interacting with our Site.

General Information

Shante Clothing ("we," "our," "us") is a clothing brand exclusively for tall women. Our website, located at [shanteclothing.com] provides you with access to purchase clothing designed specifically for tall women. By using our Site, you agree to abide by these Terms of Service, which govern your access to and use of our Site.

Acceptance of Terms

By using this Site, placing an order, or making a purchase, you signify your agreement to these Terms of Service and any other policies incorporated by reference. If you do not agree to these terms, please do not use the Site.

Order Processing & Payment

  • Order Acceptance: Orders placed on the Site are subject to acceptance by Shante. We reserve the right to refuse or cancel any order at our sole discretion, including orders that are suspected to be fraudulent or contain incorrect pricing or product details.
  • Pricing & Availability: All product prices on the Site are listed in USD. Prices and availability are subject to change without notice. In the event of a pricing error, Shante reserves the right to cancel the order or charge the correct price.
  • Payment Methods: We accept various forms of payment, including Visa, MasterCard, American Express, Discover, PayPal, Apple Pay, and Afterpay. Payment is processed immediately upon order confirmation and will be charged to your account when the order is shipped.
  • Taxes & Fees: Applicable sales taxes will be applied to orders based on your location. You may also be responsible for any customs duties or taxes on international shipments.

Shipping & Delivery

  • Processing Time: Orders are typically processed and shipped within 1-2 business days, excluding weekends and holidays. You will receive a notification and tracking information once your order has shipped.
  • Shipping Methods: We offer various shipping options, including standard and express shipping. Shipping fees are calculated at checkout and depend on the shipping method and delivery address.
  • International Shipping: We currently only offer shipping within the United States. Unfortunately, we do not ship internationally at this time. 
  • Missing or Lost Packages: Shante is not responsible for lost or delayed packages due to carrier issues. If any issues arise with your order delivery, please contact the carrier directly and they will be able to assist you.

Returns & Exchanges

  • Return Policy: We accept returns within 14 days of receiving the product. Items must be unused, unwashed, and in their original condition, with all tags attached. We reserve the right to refuse any return that does not meet these conditions, at our sole discretion. To initiate a return, please visit our Returns & Exchanges page. 
  • Exchanges: At this time, we do not offer exchanges. If you wish to exchange an item, please return the item for a refund and place a new order for the desired item.
  • Refunds: Once a return is processed, refunds will be issued to the original payment method. It may take several business days for the refund to appear on your statement. Shipping fees are non-refundable.
  • Damaged or Defective Products: If you receive a damaged or defective item, please contact us within 14 days of receiving your order. You must provide a photo of the damaged item along with your order details. We will work with you to resolve the issue.
  • Non-Returnable Items: Certain products, such as sale items or items marked as non-returnable, cannot be returned. Please refer to the product description for more details.
  • Return Shipping: Customers are responsible for all return shipping costs. We recommend using a trackable shipping service or purchasing shipping insurance for items over $75. Shante is not responsible for items lost or damaged during return shipping.

Privacy & Security

  • Privacy Policy: Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data.
  • Data Security: We use industry-standard encryption and security practices to protect your personal and payment information. However, we cannot guarantee the security of information transmitted over the internet, and you acknowledge the risks involved in using the internet for transactions.

Intellectual Property

  • Ownership: All content on the Site, including but not limited to text, images, logos, designs, graphics, and trademarks, are owned by Shante Clothing and are protected by copyright, trademark, and other intellectual property laws.
  • Usage Restrictions: You may not use, reproduce, copy, distribute, or display any content from the Site without prior written permission from Shante Clothing. Unauthorized use of our intellectual property may result in legal action.

User Conduct & Restrictions

  • Prohibited Uses: You agree not to use the Site for any unlawful or prohibited purposes, including but not limited to:
    • Posting or transmitting offensive, harmful, or illegal content
    • Attempting to disrupt, hack, or interfere with the Site’s security or functionality
    • Misrepresenting your identity or affiliation with any entity
  • Account Responsibilities: If you create an account on the Site, you are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately if you suspect any unauthorized use of your account.

Right to Refuse Service & Discontinue Products

We reserve the right to refuse service to anyone, for any reason, at any time. We also have the right to discontinue any product, service, or feature of the Site at any time, without notice. This includes but is not limited to discontinuing the availability of products, removing content, or changing product offerings.

Limitation of Liability

To the fullest extent permitted by law, Shante Clothing is not liable for any indirect, incidental, special, or consequential damages arising from the use of the Site or our products. This includes any loss of profits, data, or business opportunities. Our liability for any claim related to these Terms will be limited to the amount paid by you for the specific product or service that gave rise to the claim.

Dispute Resolution

  • Governing Law: These Terms of Service are governed by the laws of the state of Maryland, USA without regard to its conflict of law provisions.
  • Arbitration: Any disputes arising from the use of the Site or these Terms of Service shall be resolved through binding arbitration in the state of Maryland. 
  • Class Action Waiver: You agree that any dispute resolution will be conducted on an individual basis, and not as part of a class action.

Indemnification

You agree to indemnify, defend, and hold harmless Shante Clothing, its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the Site or your violation of these Terms of Service.

Modifications to Terms of Service

We reserve the right to modify or update these Terms of Service at any time, without prior notice. Changes will be effective immediately upon posting on the Site. Your continued use of the Site following any changes signifies your acceptance of the updated Terms.

Miscellaneous

  • Severability: If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Entire Agreement: These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Shante Clothing regarding the use of the Site and the purchase of our products.

Mobile Terms of Service

The Shante mobile message service (the "Service") is operated by Shante (“Shante”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Shante’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Shante through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Shante. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Shante or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Shante mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
